having regard to Art. 13 and art. 14 of Regulation of the European Parliament and Council (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation) please be advised that:

  1. The administrator of your personal data is Przemysław Żurowski doing business under the name “KONSBUD” Projektowanie i Realizacja Konstrukcji Budowlanych /Design and Implementation of Construction Structures/ Przemysław Żurowski, with its registered office in Stobno 55a, 72-002 Stobno, holding NIP 8581297743, REGON 812450938. The Administrator can be contacted in writing via post at the following address: Stobno 55a, 72-002 Stobno, via email at the email address: rodo@konsbud.com and other contact information provided on the Administrator’s website: www.systemhbe.com.
  2. The legal basis for the processing of your data is Art. 6, Sec.1, letter a) - d) & f) of GDPR
  3. Your personal data is processed since it is necessary to perform the contract concluded with the Administrator, the subject of which is performance of the works specified therein, construction works or other services commissioned to the Administrator (and failure to provide it may result in the inability to perform in your favour the subject of the contract or conduct and answering your correspondence), including to:
      • support queries, which you make via an online form on the Administrator’s website at http://systemhbe.com/become-our-partner,
      • contact you, for the purposes of supporting queries, referred to under item a),
      • support job applications made by work candidates via the form on the Administrator’s website at: http://konsbud.com/praca, (the purpose of the processing of this personal data is primarily the process of recruitment). For the remainder, the provision of your personal data is voluntary
  4. Your personal data is processed also on the basis of the legitimate interest of the Administrator, which is to ensure the security of services it provides, handling contracts, debt collection, conducting court proceedings, storage of data for archival purposes, provision of regulatory benefits and ensuring accountability (demonstration of fulfilment by the Administrator of obligations arising from the law)
  5. Your personal data is processed for the purpose and to the extent necessary to establish cooperation, respond to any inquiries, conclusion and implementation of contracts concluded with the Administrator or the performance of ordered services, records of contracts, contact with you in connection with the implementation of contracts, for archival purposes regarding information on serviced clients, settlement of contracts, as well as for possible debt collection and pursuing claims before the Court, and for marketing purposes, including such as submitting bids for the execution of ordered services - in accordance with the Act of 29.08.1997 on the protection of personal data (Journal of Laws of 2016, item 922, as amended) and Regulation (EU) 2016/679 of the European Parliament and Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC.
  6. Your personal data is also processed for tax and accounting purposes, in accordance with applicable regulations and the necessity to pay applicable public law liabilities.
  7. The Administrator processes personal data which it has obtained from you in relation to the services commissioned to it, sending inquiries whether in connection with concluded contracts or obtained as a second party to the contracts concluded with other entities (not directly from the data subjects), or court proceedings or other - extrajudicial proceedings.
  8. The administrator processes your personal data also to the extent to which it is made available by publicly available sources, i.e. acquired, among others, from the Register of Entrepreneurs of the National Court Register (KRS) and the Central Register and Information on Economic Activity (CEiDG).
  9. The recipients of your personal data are employees and collaborators of the Administrator (regardless of the legal form of the cooperation), persons providing services to the Administrator (including legal, accounting, IT, translation), related entities (capital or personal) with the Administrator. Your personal information may also be disclosed to persons and entities upon their legitimate request in accordance with the applicable rules in this respect.
  10. Your personal data may be provided to recipients in third countries, i.e. outside the European Economic Area (EEA), while this provision will be consistent with the provisions of Chapter V of the General Data Protection Regulation - ensuring the protection of the data provided
  11. Your personal data will be processed for the period necessary to implement the contract concluded with you (for the duration of the contract), for the time of providing services and possible pursuit of claims. Should you consent to the processing of your personal data - until you withdraw it. In addition, your data may be stored for tax and accounting purposes for a period determined by relevant regulations, as well as for the purpose of accountability and documenting the compliance with legal requirements, including facilitating the supervision over their fulfilment by public authorities.
  12. Your personal data is processed electronically and manually, in accordance with the purpose of their processing.
  13. In relation to the processing of your personal data, you have the right to:
    • requests from the Administrator the access your personal data,
    • request from the Administrator the correction your personal data,
    • request from the Administrator the deletion of your personal data,
    • request the Administrator to limit the processing your personal data,
    • object to the processing of your personal data,
    • make a complaint to the supervisory authority,
    • withdraw the consent at any time without affecting the legality of the processing which was made on the basis of consent prior to its withdrawal. Withdrawal of consent to the processing by the administrator of your personal data necessary for the performance of the contract may result in the completion of its performance and the provision of services, of which you will be immediately notified by the Administrator
  14. You may exercise the rights referred to in paragraph 13), addressed to the Administrator, by using contact data referred to in paragraph 1).
  15. The Administrator will make every effort to provide all means of physical, technical and organisational protection of personal data against its accidental or deliberate destruction, accidental loss, change, unauthorised disclosure, use or access, in accordance with all applicable regulations.
  16. The Administrator may, based on your personal data, make automated decisions, including profiling, referred to in Article 22 of the General Data Protection Regulation.
